Stymied by efforts to outright ignore the Second Amendment, many jurisdictions turn to excessive regulations or taxes to make it burdensome to exercise one’s rights. The latter is just what the State of Colorado is trying with the recent passage of Prop. KK.
Passed by voters last month, the new law imposes a 6.5% excise tax on all firearms, parts, and ammunition. The tax will be levied through firearms dealers. A similar law in California, which sought an 11% tax, is being challenged by our friends at the California Rifle & Pistol Association (CRPA).
“States cannot simply tax fundamental rights out of existence,” noted 2ALC President Chuck Michel. “Schemes like Prop. KK are sold to the public as funding public safety programs, but nothing could be further from the truth. They are simply a step toward disarming lawful citizens.”
Second Amendment Law Center will coordinate an amicus brief campaign, as we’ve done in many other cases, to support the inevitable legal challenge to this onerous new law.
